Terms of service.
These terms govern your use of the Lumotala website and the Founding 20 application process. They are written in plain language on purpose. If anything here is unclear, ask us and we will explain it before you rely on it.
1. Who we are
LUMOTALA (PTY) LTD, registration number 2026/553248/07, is a South African private company registered on 14 July 2026, operating a managed digital infrastructure platform for businesses, currently in its pre-launch phase.
2. These terms cover the website and applications, nothing more
These terms govern two things: your use of this website, and what happens when you apply to the Founding 20 programme. They do not govern any paid Lumotala service. Paid services are governed by a separate written service agreement, described in section 6.
3. Using this website is free and carries simple rules
You are welcome to browse, link to, and share this website. In return we ask that you do not:
- Attempt to break, probe, or overload the website or its infrastructure
- Misrepresent Lumotala, or present our content as your own
- Use the website for anything unlawful
The content on this site is provided for information. We work to keep it accurate and honest, and we correct mistakes when we find them, but the site is provided as is and we do not warrant that every detail is complete or current at every moment.
4. A Founding 20 application creates no obligation on either side
Applying to the Founding 20 programme is free. Submitting an application does not create a contract, does not reserve a place, and does not commit you to buy anything or us to provide anything. Specifically:
- We read every application and reply within three business days, but we may accept or decline any application at our discretion
- You may withdraw your application at any time by emailing apply@lumotala.co.za
- Places are confirmed in conversation, followed by a written service agreement; only that signed agreement creates obligations
- Information you submit is handled as described in our privacy notice (POPIA)
5. Pricing on this site is founding calibration pricing
Prices shown on this website for Founding 20 members are calibration prices, stated in South African rand. A price only becomes binding when it appears in a signed service agreement. For founding customers, the service agreement provides for a 90-day calibration period from onboarding, during which we measure the real cost of running the plan. The price is then confirmed in writing and locked for 24 months from confirmation, as the agreement will record.
6. Paid services are governed by a written service agreement
Before any paid Lumotala service begins, you receive a written service agreement that sets out the service scope, service levels, billing, data protection, and termination terms. Nothing on this website, including module descriptions and plan summaries, is an offer capable of acceptance or a promise of specific service levels. If this website and a signed service agreement ever differ, the signed agreement wins.
7. The Lumotala name and content belong to Lumotala
The Lumotala name, logo, website design, and website content are our property. You may quote or share excerpts with attribution. You may not copy the website wholesale, use the Lumotala brand to imply endorsement, or register confusingly similar names or marks.
8. Our liability for this website is limited
To the extent the law allows, we are not liable for loss arising from your use of, or reliance on, this website or its content. This limitation does not exclude liability that South African law does not permit us to exclude, and it does not apply to the service agreement, which contains its own negotiated liability terms. Nothing in these terms limits your rights under the Consumer Protection Act where it applies.
9. Your personal information is governed by our privacy notice
How we collect, use, protect, and delete personal information is set out in our privacy notice (POPIA). If these terms and the privacy notice ever appear to conflict about personal information, the privacy notice wins.
10. South African law governs these terms
These terms are governed by the law of the Republic of South Africa, and South African courts have jurisdiction over any dispute about them.
11. We publish changes here, and you can always reach us
If we change these terms, the new version is published on this page with a new version number and effective date. Continued use of the website after a change means the new version applies. Questions about these terms go to apply@lumotala.co.za; privacy matters go to privacy@lumotala.co.za.
Questions people ask about Lumotala's terms.
Does using the Lumotala website cost anything?
No. Browsing the website is free and creates no obligation of any kind.
Am I committed to anything when I apply to the Founding 20?
No. An application is not a contract. It does not commit you to buy anything or Lumotala to provide anything, and you can withdraw it at any time by emailing apply@lumotala.co.za.
When do I actually become a Lumotala customer?
Only when both sides sign a written service agreement after the onboarding conversation. That agreement, not this website, creates the obligations on both sides.
Is the pricing on the website guaranteed?
No. Prices shown for the Founding 20 are calibration prices. A price becomes binding only in a signed service agreement, where it is confirmed after a 90-day calibration period and then locked for 24 months from confirmation.
Where are the service levels, billing and cancellation terms?
In the written service agreement provided before any paid service begins. This website deliberately does not promise specific service levels, because honest commitments belong in a signed document.
Can Lumotala decline my Founding 20 application?
Yes. Every application is read by a person and answered within three business days, but acceptance is at Lumotala's discretion, and places are confirmed in conversation.
Can I quote or share content from this website?
Yes, excerpts with attribution are welcome. Copying the website wholesale or using the Lumotala brand to imply endorsement is not allowed.
Which law governs these terms?
The law of the Republic of South Africa, with South African courts having jurisdiction.
How will I know if the terms change?
The new version is published on this page with a new version number and effective date. Material changes that affect existing applicants are also communicated by email.
Who do I contact about these terms?
Email apply@lumotala.co.za for anything about these terms, and privacy@lumotala.co.za for anything about personal information.
